Serious personal injury cases have been the mainstay of our practice for more than twenty-five years. Mr. Garfinkle has represented over a thousand people whose lives have been changed by the negligent or wrongful acts of others. It is difficult to generalize about the sorts of victims and the types of incidents which define the “civil trial” aspect of our practice. Some tripped on broken sidewalks or slipped on ice or unshoveled snow. Others, indoors, slipped on water, salad oil, grapes, a filbert, banana peels or high-gloss wax. Still others were pedestrians who were run down by cars or trucks that hopped onto the sidewalk, or were motorcyclists who were T-boned by a drunk driver. We represent victims of negligent doctors, lawyers, accountants, stockbrokers, dentists or veterinarians. We represent victims of dangerous products that should have been made safer. We represent people who have been shot by police or attacked by police dogs in error. Other clients of ours were hurt while cycling, swimming, boating, or skiing.

We recently recovered a settlement for a client who was attacked outside a supermarket by a man with a machete! Another had his arms broken by rough handling at a nursing home. Two more were injured when a poorly-installed brick window sill fell on their heads. Another was an electrician who was electrocuted when working on a “disconnected” circuit. An equestrian client missed months of practice and competition after she stepped on a frayed lamp wire at an Atlantic City casino. A college-age client is quadriplegic for having taken a ride in a car that, unknown to her, had failed inspection for bald tires. And one young man had his nose bitten off in a racial attack in a liquor store/bar.

As a result of the wrongful acts or omissions of others, our clients have suffered injuries resulting in death, amputated limbs, paralysis, fractured and dislocated bones, TMJ, personality change, hair loss, disfiguring burns, herniated discs, Post-traumatic Shock Syndrome, food poisoning, RSD, Chronic Pain Syndrome, scarring and keloids.

We handle only a small number of serious injury cases at any one time. We take the time to develop the information and subject-matter expertise we will need to achieve the best result for you. Although you have the right to pay the attorney an hourly fee for personal injury, we usually handle these matters on a contingent-fee basis. Our standard contingency fee retainer agreement, required by NJ Supreme Court, is attached to this link for your review. Please note any questions that you have. In most cases, we advance the expenses involved in litigating the case. If we expect you to advance the expenses, we will tell you so, directly. In some cases, we may feel that a particular matter requires the resources of a larger or more specialized firm. In such a case, we will help you find such a firm, should you wish.

Although we usually represent the injured party, sometimes we defend personal injury cases. When a landlord with no liability insurance is sued by a tenant who claims plaster fell on her head, when an uninsured dentist is sued for malpractice, when an employer is sued for wrongfully firing an employee, we can help. We handle such cases on a retainer basis where we will bill you an hourly fee. You would advance all case costs as they come due.
