Ordinance and Code Violations in Municipal Court New Jersey

The Municipal Court is the clearinghouse for all violations of municipal ordinances, local codes, and some state codes which control some of the details in the way we live, play and work. In general, violation of an ordinance is a less serious offense than crimes which are handled at the county court, although the fines and penalties may be harsh. Jail may be imposed by the court, as well. Conviction of an ordinance is not a crime, and does not get entered into one’s criminal record.

Ordinances address such matters as maintaining a nuisance, illegal dumping of trash, curfew violations, parking regulations, failure to shovel snow, creating a disturbance, and illegally distributing flyers. Violations of these ordinances are usually quasi-criminal in nature.

Typically municipal courts enforce a number of local and state codes. These include the Health Code, Business and Professions Code, building and construction codes and many others. Usually, the code–enforcement official or a police officer is present in court as the prosecution’s witness. Like ordinances, conviction of Code violations (other than the Criminal Code, Title 2C) does not constitute conviction of a crime, and does not appear in any criminal record.
